Inheritance Hijackers - Who wants to steal your inheritance and how to protect it
Attorney Adamski's new book will be published by Ovation Books in 2009.
This is the first book to reveal, educate, illustrate, and advise:
1. Who steals inheritances.
Every family is at risk. Close relationships enable the inheritance thief.
2. Why, When and How inheritances are stolen.
Flawed human nature, neglect and inexperience are major factors.
3. Why we all are potential victims.
There is no safe haven in our imperfect world from a thief who covets an inheritance.
4. How to protect yourself.
Knowledge is power. The knowledge gained from this book will empower and help protect the reader’s family.
Inheritance, the transfer of assets from one generation to the next, is essential in all
societies. Theft of inheritances, I call it "hijacking inheritances", has occurred since Cain murdered Abel. An inheritance is hijacked when a person intends to transfer an asset, and the asset is diverted by the hijacker to an unintended recipient.
There are two victims to each hijacking. The first is the person intending to give the inheritance. The second is the person who should receive the inheritance. In our times everyone is a potential victim. It may surprise you that Hijackers are almost always a trusted person, perhaps a family member or close associate. Hijackers operate in the shadows, using fraud, forgery, and undue influence as the tools of their trade. These acts are not easily discovered, difficult to prove and rarely punished.
In my thirty years of practicing law, I have handled more than a thousand inheritance disputes. Hijacking incidents have sharply accelerated in the last decade, causing me to take note of both the epidemic and the root causes of this phenomenon. What I learned is alarming. The legal advice and case studies in this book educate the reader on the many dangers to their own inheritance from many fronts. Most people are completely unaware of, and therefor not sensitive to, the risks which make them the perfect potential victim. The knowledge in this book will provide the readers with power to protect their own inheritance and secure their future.
What is at risk? The baby boomers’ hijacking epidemic is well underway. More wealth than anyone can imagine, an estimated hundred trillion dollars, will be inherited by baby boomers and their children in the next twenty years. Much of this will be hijacked by trusted family members or close associates, all wolves wearing sheep’s clothing.
Who is at risk? Size of the inheritance is not a critical factor. Anyone expecting an inheritance, however small or large, can expect someone to covet that inheritance and attempt a hijacking at the first opportunity.
How can you be protected? Your lawyer can provide some protection, but only from known dangers. Hijackers are unknown dangers who operate covertly outside the law. Knowledge and vigilance are the best protection.
This book is divided into two parts. Part One, comprised of chapters one through seven, explains in plain English the laws governing inheritances, how the hijacking is accomplished, and the most important and fascinating element, the psychology behind the hijacking. The subject matter progresses from the simple to the complex.
Chapter one is a walk inside the world of inheritance theft.
Chapter two is a primer on estate planning that explains the basic laws of estate planning and how assets are transferred through inheritance.
Chapter three discusses the many potential victims of a hijacking and how many of them make themselves attractive targets for the hijacker.
Chapters four and five discuss inheritance laws and the legitimate ways a victim can recover their hijacked inheritance under the law.
Chapter six lays out the anatomy of an inheritance suit from start to finish, giving the reader an idea of what victims face when recovering a hijacked inheritance.
Chapter seven is a practical guide to assessing personal risk ans what steps the reader should take to start fortifying their inheritance.
The working knowledge gained in Part One is the first step to fully understanding the subject. The case studies in Part Two illustrate how the information in Part One is applied in real life situations. Part Two consists of case studies of actual hijackings and resolutions. These case studies are entertaining and educational in short story format revealing some of the many different ways inheritances are actually hijacked and how the law treats those different situations. The reader will see themselves and others within the characters in some of these stories, either as victim or hijacker.
First explaining the law and then demonstrating how the law is applied in actual cases is the training format used in law schools to train lawyers. At the conclusion of this book the reader will have a sound understanding of how, when, and where a hijacking can occur.
Armed with this knowledge and understanding the reader can hopefully safeguard their inheritance.
